Terms & Conditions
Terms and Conditions (“Terms”) govern the purchase and use of digital resources and services supplied by Unified Education (ABN 29658638274) (“we”, “us”, “our”). By purchasing, downloading, or using our resources, you (“you”, “the purchaser” or “the member”) acknowledge that you have read, understood, and agree to be bound by these Terms, and that you have the legal capacity to do so. If you do not agree, you must not use our resources.
1. Definitions
For the purposes of these Terms:

“Resources” means all digital materials made available by Unified Education, including Purchased Resources and Free Resources.

“Purchased Resources” means any paid digital resources made available for purchase via our Website, including ZIP, PDFs, Word documents, and Excel files and other file types.

“Free Resources” means any digital resources made available free of charge to registered Members of Unified Education.

“Member” means a person who has registered an account on the Unified Education Website and agreed to these Terms.

“Website” means the Unified Education website located at www.unifiededucation.com.au, including any subdomains, platforms, or member portals operated by Unified Education.

“VCE” means the Victorian Certificate of Education.
-
“VCAA” means the Victorian Curriculum and Assessment Authority.
-
“Intellectual Property (IP)” means all rights, title, and interest in Resources, materials, content, branding, and trademarks belonging to Unified Education.

“Fees” means the charges payable for Purchased Resources.
-
“Ordering” means the process by which Resources are purchased via the Unified Education Website.
-
“Purchase Order” means an order placed by a school or teacher requiring invoicing and payment through the school system.
-
“Support Email” means support@unifiededucation.com.au, being the contact point for disputes, complaints, and technical issues.
-
“Immediate Teaching Team” means the group of teachers directly responsible for teaching the same subject or year level at the purchaser’s school, excluding broader staff access.

“Commercial Use” means any use of Resources for profit, financial gain, or distribution beyond classroom educational purposes, including but not limited to resale, sublicensing, publication, or incorporation into commercial products or services
2. Respectful Communication and Acceptable Use

All engagement and communication with Unified Education, including customer support, must be conducted in a respectful and professional manner. Unified Education reserves the right to terminate current and future engagement with any person who engages in abusive, offensive, or unprofessional communication.

You agree to use Unified Education Resources responsibly, in compliance with all applicable laws and regulations. Misuse of Resources, including distributing unlawful, offensive, or infringing content, will result in termination of access and may give rise to legal action.
3. Purchased Resources – Licence to Use
When you purchase a resource, Unified Education grants you a non-exclusive, non-transferable, revocable licence to use the resource under the following conditions:

The licence is for a single user (the purchaser) only.

Resources may be printed in unlimited quantities for classroom student use only.
-
Printed Resources may not be distributed to parents, carers, or third parties outside the school context.
-
Resources must not be uploaded or shared digitally with students through learning management systems, intranets, websites, email, or any other public or student-facing platforms (e.g., Compass, Canvas, OneNote).
-
Resources may be shared securely within the purchaser’s Immediate Teaching Team only, provided access is restricted to staff.
-
Redistribution, resale, sublicensing, or public sharing of Purchased Resources in any form is strictly prohibited.
-
Access credentials (such as passwords or codes) provided with Resources are confidential and must not be disclosed to students or any third party outside your Immediate Teaching Team.
4. Free Resources – Licence to Use
Unified Education may make certain resources available free of charge to registered Members. Use of Free Resources is subject to the following conditions:

Free Resources are available to Members only and may be downloaded and used at no cost.

Free Resources may be shared with students, colleagues, and within schools, including uploading to intranets or digital platforms.
-
Free Resources may be printed and displayed in classrooms without restriction.
-
Free Resources must not be edited, altered, or modified in any way. They must be used exactly as made available, with all Unified Education branding intact.
-
Free Resources must not be resold, sublicensed, or incorporated into any commercial product or service.
5. Non-Commercial Use
All Unified Education Resources are provided for non-commercial, educational purposes only, unless prior written permission is obtained from us.

Resources (whether in original or edited form) must not be resold, sublicensed, published, redistributed for profit, or incorporated into commercial products or services.
-
Purchased Resources may be edited or adapted for your own teaching purposes, but must not be exploited commercially in any way.
-
Free Resources, while available at no cost, remain the copyright and intellectual property of Unified Education and must not be repackaged or exploited commercially.

For any use outside of the scope of these Terms, you must first obtain written permission from Unified Education.
6. Editing and Branding (Purchased Resources)

If you use a Purchased Resource in its original form, all Unified Education branding, copyright notices, and trademarks must remain intact.

If you edit, adapt, or modify a Purchased Resource, you must remove all Unified Education branding and logos before use or distribution.
-
You are not permitted to represent edited versions as original Unified Education resources.
7. Intellectual Property

All Resources, materials, Website content, and related products are protected by copyright and intellectual property laws.
-
Unified Education retains all rights, title, and interest, including copyright and trade mark rights, in the name “Unified Education” and its associated logo (trademark pending).
-
Purchase of a resource grants you a limited licence to use it under these Terms. Ownership of intellectual property rights does not transfer.
8. Authorship, Independence, and Similarity

Unified Education Resources are developed by experienced educators, including current teachers, who contribute their expertise to ensure the quality and relevance of our materials.
-
The involvement of teachers in resource creation does not imply any endorsement, authorisation, or affiliation by their employers, schools, or other educational institutions. Our Resources are original works produced independently by Unified Education.

Many commercial educational resources are based on the same curriculum frameworks (including the VCE Study Design). As a result, assessment tasks created independently by different providers may contain similarities in structure, style, or subject matter. Such similarity does not, in itself, constitute a breach of copyright or intellectual property.

Unified Education does not reproduce, copy, or adapt assessments or other resources created by other education providers or schools. We take care to ensure our Resources are unique and respect the intellectual property rights of others.

Where external materials such as articles, reports, or data sets are used as supporting stimulus in assessments, they will be acknowledged or attributed appropriately.

If you believe any of our Resources infringe your intellectual property rights, please notify us immediately at support@unifiededucation.com.au. We will review and, if appropriate, take prompt action to rectify the issue.
9. Trademarks and VCE Disclaimer

Unified Education™ (name and logo) is a pending registered trademark of Unified Education.

Unified Education is an independent provider of educational products specialising in the Victorian Certificate of Education (VCE®) curriculum.
-
“VCE” and “Victorian Certificate of Education” are registered trademarks of the Victorian Curriculum and Assessment Authority (VCAA).
-
Unified Education is not affiliated with, sponsored by, or endorsed by the VCAA.
-
Any reference to “VCE” is descriptive only.
-
For official information regarding the VCE curriculum, assessments, and related matters, please refer directly to the VCAA.
10. Fees, Orders, and Payment Terms

All Fees for Purchased Resources must be paid in full at the time of Ordering via the Unified Education Website.
-
If a teacher or school elects to purchase via Purchase Order, an invoice will be issued. Payment is required within 14 days of invoice date.
-
Resources ordered via Purchase Order will not be released until full payment has been received and confirmed.
-
Failure to make timely payment may result in cancellation of the order and restriction of future access.
11. Refunds and Consumer Guarantees

Unified Education does not provide refunds for change of mind purchases.
-
Refunds or replacements will only be provided as required by the Australian Consumer Law (ACL).
-
Nothing in these Terms excludes or limits your statutory rights under the ACL.
12. Student Outcomes Disclaimer
-
Unified Education Resources are developed with reasonable care, skill, and expertise.
-
However, we do not guarantee that use of our Resources will result in specific student outcomes, grades, or performance improvements.
-
Results depend on a variety of external factors beyond our control.
-
Any testimonials, endorsements, or anecdotes are genuine opinions of others but are not indicative of guaranteed outcomes.
13. Changes to Website, Services, and Products
Unified Education may update, modify, or discontinue Resources, services, or the Website at any time without notice. We are not liable for any loss, damage, or inconvenience caused by such changes.
14. Third-Party Platforms
Access to Resources may involve use of third-party platforms (e.g., cloud storage, learning management systems) that are beyond our control. Unified Education makes no representations regarding their continued availability or performance and disclaims all liability for service interruptions or changes made by those platforms.
15. Breach of Terms
If you breach these Terms:

Your licence will be immediately revoked.
-
You may be permanently banned from future purchases.
-
We reserve the right to seek legal remedies, including injunctions, damages, or costs.
16. Dispute Resolution and Complaints

If you have a complaint or dispute, you must first contact us in writing at support@unifiededucation.com.au, outlining the issue.
-
We will acknowledge receipt and aim to resolve the complaint within 30 days.
-
If the complaint cannot be resolved internally, you may escalate the matter through external dispute resolution processes or the courts.
17. Limitation of Liability

To the maximum extent permitted by law, Unified Education excludes all liability for any indirect, consequential, incidental, or special loss or damage.
-
Our liability is limited to resupplying the Resource or refunding the purchase price, where required by the ACL.
-
Unified Education will not be liable for any failure or delay caused by events beyond our reasonable control (including internet outages, cyber-attacks, or force majeure events).
18. Privacy and Data Use
Your personal information is collected and managed in accordance with our Privacy Policy. By purchasing or downloading Resources, you consent to such handling.
19. Governing Law
These Terms are governed by the laws of Victoria, Australia and applicable Australian law. If you reside outside Victoria, these Terms apply subject to any mandatory consumer protection laws in your jurisdiction.
Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
20. Severability and Non-Waiver
If any provision of these Terms is held invalid or unenforceable, the remainder will remain in full force and effect. Failure by Unified Education to enforce any right under these Terms does not constitute a waiver of that right.
21. Updates to Terms
Unified Education may update these Terms at any time. Updates will be published on this page, and your continued use of our Resources constitutes acceptance of the updated Terms.
